Texas Proposal: JAIL Any Federal Officials Trying to Enforce New Gun Restrictions in the State

A Texas lawmaker says he plans to file the Firearms Protection Act, which would make any federal laws that may be passed by Congress or imposed by Presidential order which would ban or restrict ownership of semi-automatic firearms or limit the size of gun magazines illegal in the state, 1200 WOAI news reports.

Republican Rep. Steve Toth says his measure also calls for felony criminal charges to be filed against any federal official who tries to enforce the rule in the state.

"If a federal official comes into the state of Texas to enforce the federal executive order, that person is subject to criminal prosecution," Toth told 1200 WOAI's Joe Pags Tuesday. He says his bill would make attempting to enforce a federal gun ban in Texas punishable by a $50,000 fine and up to five years in prison.

Toth says he will file his measure after speaking with the state's Republican Attorney General, Greg Abbott, who has already vowed to fight any federal measures which call for restrictions on weapons possession.

Toth concedes that he would welcome a legal fight over his proposals.

"At some point there needs to be a showdown between the states and the federal government over the Supremacy Clause," he said.

The Supremacy Clause is the portion of the Constitution which declares that federal laws and statutes are 'the supreme law of the land.'

"It is our responsibility to push back when those laws are infringed by King Obama," Toth said.

Texas is the second state to propose a measure to shield the state from the impact of any gun possession restrictions imposed by Congress or by Presidential order. A similar measure was introduced in Wyoming last week.

Oh Good Lord, I cannot think you believe all of this.

Problem with our country. Ignore the facts. Bandaid things. Ignore what is and shout and spew just silly things and repeat things that make no sense.

Obama is not spinning the country out of control.

It was spun long before he got in office. When he leaves office in four years, things will be the same, more/less.
I am disappointed in him in that he is there at a pivitol point in history and radical cahnges need to be made and he , same as his fellow Republican PofTUSA, Democrat ones, is just following along, doing the same really.

Changes, RADICAL ones that should be made and rechange OUR country ,some:
1-Eliminate members of Congress from having that pension.
2-Eliminate the PofTUSA from him, Obama , and future PofTUSA from their pension.
3-Radical RADICAL changes to welfare system such as elimination of redundant programs like WIC.
4-Cut foreign aid.
5-Stop supporting terriosts dictatorships.
We LOVE supporting terriosts dictatorships.

Think from terriosts dictatorships and/or dictatorships of theives from the times of Papa Doc, Baby Doc ( Haiti's Duvalliers), Marcos, Sadamm Hussien, Mubarack, to now the Pakistanin and Afganistan leaders, Mexico's head LOL, these people are making a fool of us just the past ones did over and over again.
Oh Cuba, baaaaad. No. No relationship with Communist Cuba. Communist China, good. We like China.
This makes no sense. China loves them some Iran too.

6-Enforce workfare.
7-Push capital punishment here. Now, you are talking 'bout something.
8-Infrac. here and jobs. Construction could boom if you build more jails.
9-Fairer tax system and everything for the Middle -class.
10-Term limits for all elected officials. State and national elected officials should have term limits.


Gun control, as PofTUSA, after what mass murder happened again, he has to say, do something, even if it is a temporary bandaid. Noise really. Just some writing for the newspapers.

Obama won't take guns away from the inner city Black youth who kill up and rob innocent people. They voted for him and he won't take their guns away.

That should be done. Buying a gun at will like you can buy one like a candy bar from Walmart, gun shows should not be.
You cannot buy a car like that. You need the insurance , legal age, etc., before the dealership will let you buy a car from them cash outright or finance.


Good gun control new laws or things to enforce, if you own a gun, good.
YOU are held responsible so if you let your gun go off and shoot somebody, you pay the price. Here in Kingwood, TX, somebody , Hillbilly White, had a gun at a family restaurant, and it went off and shot some Old White lady . Luckily it was her leg or something, but still.
Why bring a gun into a family restaurant?
People have to be held responsible for their actions be it a gun, dog, etc., just like you do for your automobile.
Columbine parenbts should have been held responsible for what their criminal kids did. Ohh, these parents never noticed that their menatally deranged, sick, boys had an arsenal in the garage.
Now, one of the so-called mothers has written her book about how she can see he felt bullied or alone. Oh please shut-up.

Guns are not going to outlawed. Criminals will always have fairly easy access to guns. Guns are sold like candy bars at Walmart.
If anyone thinks they are going to take guns out of the hands of the Bloods and Crips, let me know when you are going to CA to do this so I can take vacation day to go to your funeral.

Guns control , basic laws that we have, need to be enforced.

if you own a gun, you per the law, should be held responsible for it same as your automobile, dog, child if you are a good parent.


The NRA could , should meet society , educate them, send out good pr about gun ownership instead of the old way of revving up the public like Deceased Charlton Heston used to, get the public to be responsible gun owners.

I do not know how, if it would work, but it would be good pr for NRA.

This crazy, nutty, mentally off , NRA member, gun loving , Upper class White, old ,stupid woman in CT, should not have had any guns in her house knowing she had a crazy azz son. She really should have had him sent away in a crazy home. She said to a tutor or babysitter when he was a young child, to never turn your back on him. She said to friends that she was frightened of him. He was getting harder to control Google the dailymail.com
Search there. Read the articles. Why did she , so stupid, need and want and buy these guns? One was too many. She had a few high powered weapons.
She taught that mental , headcase son of hers how to fire guns and where they were and everything when he was a child.
Well, story turned out to be, he blew her head off to start and we know the rest.
She was the same as these Ghetto urban mothers. One, she, was rich , White lived in a small wealthyish town and the others are inner city, poorish, Black. How do you fix stupid in this country? Both of these types of women are stupid and gave birth to devils.
Who do you file a lawsuit against in this CT? No one. The money , home she had was significant, but she had hardly enough for all the lawsuits . Yes, they all should file a lawsuit against her estate. The other son can kiss that goodbye.

Who goes to jail here? No one. The cazy mother and her crazy son are both dead.
How do you legislate what?
With freedoms came responsibilites.
With freedoms, it is one for all as in , to me, one law for all.
Bloods, Crips get guns and some of them, I imagine legally if they don't have a record yet or buy one from Walmart or pawn shops.
People who hunt, want a gun for protection because it is rights rights, freedoms, well, they can too.

How to stop those who don't need a gun from getting one?
You really cannot .

Back to the real question, real meaningful talk here, how to do this?
In our country, under our laws, you really cannot stop people from getting guns.





Oh , by the way, I understand Ausbergers, Autism and none of that had anything to do with this demonic mother and son. I am not making fun of those witb Autism, Ausbergers. I have worked with those typoe of kids. Killers, they are not. They will run away from you if anything.
Prefer to avoid people if possible -Ausbergers.

Is what Steve Toth suggests really doable? I mean since you have the supremacy clause in the constitution wouldn't that overrule any such laws passed by a state?

From what I have gotten to understand around here the constitution is something like the holy gospel, why would there have to be a showdown about something in the constitution?

To put it simply: Because States rights have eroded over time. Because the Federal government has, over time, assumed for itself rights not granted to it specifically.

So long as the Fed is acting within the Constitution (limited power) there's no issue with the Supremacy Clause. The problem is the Fed has overreached the powers granted to it by the Constitution over and over and over and over and over and over and over and over and over and over and over and over and over and over and over and over and over again.

Because, in a recent example, a Judge decided that Obama, when he said Obamacare was NOT a tax, concluded that what he really meant was that it was a tax.

Say what?

Yeah. Me too. So now the Federal government steals more power (and money). The payroll tax is another excellent example.

A Constitutionalist would tell you it is very simple. The powers granted to the Government are extremely limited...EXTREMELY limited...on purpose.

From the beginning there has been a faction of American's who have attempted to circumvent and even eliminate it. It isn't anything new. The Constitution says:

The Fed can borrow money
It can collect taxes to pay the bills
It regulates commerce with other nations and between states
It prints money
It controls naturalization
It handles the mail
It provides an Army and the Navy

And that's about it really. The Constitution references a provision for the "general welfare" of the people, and of course that has been interpreted as a validation for any and every social policy under the sun.

So then, when the Fed wants to force citizens to buy health insurance (unConstitutional) it simply says it's for the 'general welfare' and calls it a tax.

Now you tell me. Is that overstepping the Federal powers provided in the Constitution?

Obama has done nothing to be impeached on.
People have been tyring this nonsense for four years now since Nov. 2008, LOL!! Outside of my post office, some people had their pics of him with the drawn on Hitler facial hair and the impeach table there and this was way last year in May or April.

You would have been thrown under the jail and called every name in the book by people entering and leaving the the post office and removed from the US post office if you had an Impeach Bush table out there. Lets be real.

Obama , for the umpteenth time CANNOT CANNOT WILL NOT WILL NOT be able to remove guns from the criminals, law abiding citizens, no one who wants to get one or buy any kind of way they do.


US Constitution, State's Rights, USA 's rights over the states, basically it is pretty simple.

Sates have rights within the laws/rights of the USA. United STATES of AMERICA.
When is the Fed govt., USA overstepping THEIR rights into THEIR states's rights?
Not much really.
USA owns the states. States are not little foreign countries or parts of the Commonwealth free to do as they please and have laws, body of govt., head of state differnt from those of the USA.

Lets call a spade a spade.
Never never heard on all of this talk about the Consititution until that guy, you know, Obama, became president.
For what it is worth, I am not wholly in favor of all about him, but wholly against all about him either.

Obamacare. Not best example.
Poor,uninsured, whatever get health care and got it before Obama care. Bills from hospitals etc. are passed on the states. States pass on bill to FEDERAL GOVT. of The United States of America.
Feds pay it up to the states.
Feds take care of THEIR STATES and citizens. I wish OUR govt. would take care of OUR STATES more and less of the rest of the world.


That is what makes the United States of America great.
