The NFL Players Association asked an arbitrator Tuesday to determine whether New Orleans Saints quarterback Drew Brees has been hit with the franchise tag for a second time, according to sources.

On face value, my vote is yes. Only because the CBA is what governs this item and the CBA is not "Team specific", therefore it is an agreement between the players and the league.

The only other question I would have is, is there already a precedent set?

Has another player been FT by two teams and how did that pan out?

I say no. The line in question from the article: The applicable language in the collective bargaining agreement says "any club that designates a player for the third time ..."

Any club (singular) that designates a player for a third time.

I read that as if a club, say the Saints, designates Brees for a third time, then he gets that 144% tag money.

If it said: "Any player that has been designated for a third time..." Then I would agree, the Saints are liable to pay him his tag plus 20%.

But I'm no lawyer.
