Too soon to tell anything conclusive, but based on Judge's lengthy questions, field has tilted in Vilma's favor

Wish they would list the concerns.

If the judge finds the concerns overwhelming enough from these cases:

Could the current CBA be vacated due to the way it is written?

Interesting turn...basically on the eve of the season.

NFLPA attorney Jeffrey Kessler comes out of nowhere swinging with a fiery argument on failure to exhaust remedies

Kessler: We asked Goodell not to rule on appeal b/c panel had not been formed yet for Burbank's decision. It was they who forced our hand
Quote:

Kessler: Because the NFL ruled on June 18, we are left with no other options. Panel doesn't exist. The failure to exhaust is a "red herring"

Beastmode 07-26-2012 03:58 PM

The tables have turned...Kessler could be finding a new employer if this doesn't go away.

Legal pundits are saying that the Judge is saying the NFL over-stepped their bounds (LEGALLY) on the Appeal. She's saying that Goodell should NEVER have been Judge at the hearing and arbitrator at the Appeal.

THIS IS HUGE FOR ALL THE REST OF ALL THE CASES! Not just this restraining order.

NFL ON THEIR HEALS FIRING BACK DIRECTLY AT THE JUDGE!
Don't think they're WINNING LOL

NFL firing back at Berrigan on Goodell's jurisdiction: "Those were findings made by Professor Burbank, who has seven years experience..."

Gregg Levy, NFL attorney: "I'm not saying (Burbank) gets them all right because we've lost a few."

Summing up NFL's attempt to tilt field back in their favor- judge simply doesn't have power to decide jurisdiction of arbitrators.
