Tom Benson's fired personal assistant must take complaint to NFL commissioner
 
Saints owner Tom Benson's longtime personal assistant who was fired last year must take his complaint over back pay to NFL Commissioner Roger Goodell for binding arbitration, according to court filings by the Saints on Friday (Jan. 15).

Rodney Henry, Benson's personal assistant for 25 years until last June, argues the Saints violated federal labor law by failing to pay overtime for the regularly long work hours required to keep up with the demands of the 89-year-old billionaire and his wife, Gayle Benson. He filed a lawsuit against the Saints in federal court in New Orleans in November.

On Friday, in the team's first response to the lawsuit, lawyers for the Saints said Henry signed an agreement on July 24, 2010, requiring him to follow the NFL's rules that force employee disputes into binding arbitration with the final decision made by the NFL commissioner.

The NFL's constitution mandates that "the commissioner shall have full, complete and final jurisdiction and authority to arbitrate any dispute between any ... employee of any member of the league ... and any member club or clubs," the motion says.

So what is it? Is it overtime or is it back pay? If it is overtime, lol, good luck with that. If he is a salaried employee (meaning he don't punch a clock) then he is entitled to NOTHING as far as overtime is concerned. I don't know if it is different in other states but in Louisiana this is how it is.

Then if it is back pay, he is also got nothing. Once your employment is terminated, you are done. Louisiana is an employment at will state. Unless there was a contract and the contract was violated by Benson, this guy has nothing and Bensons lawyers will make sure of it.

Why does he wait so long to file a complaint? Why not do it while he was employed? I'll tell you why... sour grapes. Sometimes you get fired because you deserve to get fired. Don't complain about things that happened in the past after the fact. Either man up at the time, or lick your wounds and go home.

Well if he complained while he was employed, he may have been worried about being fired for not being a Team Tommy player...

With that threat removed, he's asking for what he feels he's rightfully due...

I for one hope he can hire hire a writer and publish a book, or produce a two season sitcom at the least...

...bet there's some funny stories about Tommy and his eccentricities; I'd like to know what cause was given for dismissal...

oh cry me a river. employers have been holding jobs over peoples heads since the idea of work was dreamed up. paid for 40 and working 50 to keep the job is a dead horse
