Tom Benson's fired personal assistant must take complaint to NFL commissioner

Saints owner Tom Benson's longtime personal assistant who was fired last year must take his complaint over back pay to NFL Commissioner Roger Goodell for binding arbitration, according to court filings by the Saints on Friday (Jan. 15).

Rodney Henry, Benson's personal assistant for 25 years until last June, argues the Saints violated federal labor law by failing to pay overtime for the regularly long work hours required to keep up with the demands of the 89-year-old billionaire and his wife, Gayle Benson. He filed a lawsuit against the Saints in federal court in New Orleans in November.

On Friday, in the team's first response to the lawsuit, lawyers for the Saints said Henry signed an agreement on July 24, 2010, requiring him to follow the NFL's rules that force employee disputes into binding arbitration with the final decision made by the NFL commissioner.

The NFL's constitution mandates that "the commissioner shall have full, complete and final jurisdiction and authority to arbitrate any dispute between any ... employee of any member of the league ... and any member club or clubs," the motion says.

Ginger is going to hear this, Benson should start writing the check now and just fill in the amount after the dog and pony show is over. No way Benson wins this one

So what is it? Is it overtime or is it back pay? If it is overtime, lol, good luck with that. If he is a salaried employee (meaning he don't punch a clock) then he is entitled to NOTHING as far as overtime is concerned. I don't know if it is different in other states but in Louisiana this is how it is.

Then if it is back pay, he is also got nothing. Once your employment is terminated, you are done. Louisiana is an employment at will state. Unless there was a contract and the contract was violated by Benson, this guy has nothing and Bensons lawyers will make sure of it.

Why does he wait so long to file a complaint? Why not do it while he was employed? I'll tell you why... sour grapes. Sometimes you get fired because you deserve to get fired. Don't complain about things that happened in the past after the fact. Either man up at the time, or lick your wounds and go home.

Well if he complained while he was employed, he may have been worried about being fired for not being a Team Tommy player...

With that threat removed, he's asking for what he feels he's rightfully due...

I for one hope he can hire hire a writer and publish a book, or produce a two season sitcom at the least...

...bet there's some funny stories about Tommy and his eccentricities; I'd like to know what cause was given for dismissal...

He's probably hoping to settle out of court because Benson is juggling so many issues now.

... and/or feels the race card is something he can get heard outside of the NFL process/jurisdiction and in the courts as he originally intended?

If they go in front of Roger he might sure enough lose more than the lawsuit. He might get suspended for a year or possibly really lose all power.

This racism crap is out of hand....
You can't even call someone who is black and a son of a BlTCH a Black Son of a BlTCH?

What is this world coming to. I'd like to know what they called Tom Benson. That will never be published.

Black racism never gets published because there is NO MONEY IN THAT. Black people can be 100x more racist and never get called out for it. In fact, if you do, they call you a racist and get away with it. Black people are taught in a mass black culture to designed racism against white people at the drop of a hat. They see no problem acting racist to their own race and making fun of the millions of people who are devoted to crime. If white people bring this up, they are racist and a law suit will follow. FOLLOW THE MONEY MACHINE.

Both races need to wake up. Who wants to hire employees that have be taught to sue at the drop of a hat ASAP!!!

Wait... Was he black?

I really don't care what they do in their personal lives as long as it doesn't interfere with the play on the field and the team stays in New Orleans

Saints deny racial discrimination allegations from former employee | ProFootballTalk

“Both Tom and Gayle Benson are extremely hurt by Mr. Henry’s filing yesterday in federal court in New Orleans and the ridiculous accusations made in the filing,” Bensel said. “They had hoped that the dismissal by the Equal Employment Opportunity Commission of his claims would end this matter. The Bensons considered Mr. Henry to be a part of their family, providing for him and his children for some 20 years and they are both very disappointed that he has decided to assert these accusations of harassment and discrimination. Make no mistake, the Bensons and the New Orleans Saints will vigorously defend these baseless claims.”
