Lawsuit alleges Aaron Hernandez shot man in Florida
New England Patriots tight end Aaron Hernandez is dealing with more than one legal problem. Just one day after law enforcement was at Hernandez's Massachusetts home in connection to a possible homicide investigation, news emerged of a civil lawsuit filed against Hernandez in Florida.
NFL.com obtained a copy of the complaint filed June 13 in a federal court in South Florida. The complaint alleges that, on Feb. 13, Hernandez and Alexander S. Bradley got in an argument while at a strip club in Miami-Dade County. The complaint said that later, while driving toward Palm Beach County, a gun in Hernandez's possession discharged, hitting Bradley. The lawsuit alleges that the shooting caused Bradley to lose his right eye, among other injuries. The complaint also said that Hernandez's gun was not properly licensed. The case was voluntarily withdrawn on June 17, but a lawyer representing Bradley told NFL.com the case has not been resolved, and he refiled a new complaint Wednesday. He said the first complaint was withdrawn because of an error in the filing. Lawsuit alleges Aaron Hernandez shot man in Florida - NFL.com |

No arrest yet.

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
This is high profile, the DA is going to tread carefully.
He is going to take a hit before it is all over for a minimum of obstruction of justice, and interfering with an investigation. He destroyed his home security system and his cell phone when asked to furnish. |

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
Arrested now. It was 8:45 AM EST.
He has been taken into custody. All those big guys in suits, you know the FBI ones, went to pick him up. See NFL Network tonight. Story still developing. This trash is a goner for good. Now,interesting, NFL Net is talking about the new collective bargaining things whereas if a player is in legal trouble like, the team has ways to financial protect themsevles from paying these guys. Correct me someone. I am getting , I think , part of this story right. I just turned it on. Good for the NFL teams there. That is fair for them. I agree with that. |
Re: Lawsuit alleges Aaron Hernandez shot man in Florida

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
Ok, pardon me.I know this is mean.
Hey, Honeybadger Tyron Matthieu, you next!! Hopefully that guy is looking and seeing this and realizing now with his good chance in AZ he does not want any legal trouble and crimes . |
Re: Lawsuit alleges Aaron Hernandez shot man in Florida
Patriots waived TE Aaron Hernandez.
The Patriots clearly have no faith that Hernandez will be exonerated following his Wednesday morning arrest. They're willing to eat a ton of money in bonuses and guaranteed base salaries, and will be facing roughly $10 million in dead money against the salary cap over the next two seasons. The Pats are also left with perhaps the weakest group of pass-catchers in the entire NFL. Their statement: "A young man was murdered last week and we extend our sympathies to the family and friends who mourn his loss. Words cannot express the disappointment we feel knowing that one of our players was arrested as a result of this investigation. We realize that law enforcement investigations into this matter are ongoing. We support their efforts and respect the process. At this time, we believe this transaction is simply the right thing to do." Hernandez is now subject to waivers, meaning any team can submit a claim by 4 p.m. Thursday. We'd be shocked if anyone does. via rotoworld I'm surprised there's no language in these contracts to protect teams from certain situations. Quote:

I want him if he beats the charges.

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
I'd let him be someone elses headache. We've had enough distractions this past year to last a decade.

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
I dont know enough about what happened to comment on the crime but are you not innocent until proven guilty?
Surely they will be able to void the contract in court, the man if convicted will not be able to do what he is contracted to do. Plus its the patriots, commissar will burn the contract and claim it has wording alloing them to terminate either that or he will give them cap relief and probably a nice high compensatory pick in next years draft |

Graham, Hernandez, Colston, Moore, and Sproles.....it sounds like so much fun! Here's hoping he did nothing wrong and we pick him up. I can understand those who don't want him though.

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
He's as innocent as OJ.
Best case scenario, he becomes an accessory to murder. Unless he starts snitching(I don't think he shot the guy but he certainly was involved and tried to cover it up) and gets some kind of plea bargain, he's doing time. But lets say he somehow manages to kick the charges, you really want this guy in your locker room? |

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
No thanks. We got enough problems without inviting more.
If the Patriots couldn't keep him in line, there's no reason to think anyone else could. It's not like they are the Raiders. |

Re: Lawsuit alleges Aaron Hernandez shot man in Florida
If, by a miracle this guy is innocent ....no way to picking him up.
I canot even hardly post the thought of it. Best thing, good thing, the Saints have had for these years is very little with showoffs, distractions in players, etc. No, they were perfect, but they at least ran the norm of other teams. NE Pats handled this guick and fast. Get rid of this guy right away before training camp really starts and and other things. they want no mention of him ever. NEPats have as much connection to this guy as they do to me. He was simply a player they had on their team . Over and out and done. |

Not a locker room cancer, please. This is the same guy the week after he was drafted, wanted to fight Wes Welker because Welker told him to figure out the tap machine on his own "rook"

However Teams could put that into their contracts just to double up (per sey) Section 9 of the CBA address this even though it is not in his specific contract. Essentially as I read it, Section 9 which covers Forfeiture of Salary section (a) breach - when Hernanadez fails to report for anything due to "conduct by him due to incarceration" he may be required to forfeit signing bonus, roster bonus, option bonus and or option bonus but not salary for each year he does not show. His salary is forfeited on a % basis for the remaining years. Now forfeit in this means not receive.. What ever he already has he keeps, and what ever he has kept is a Cap hit for the Pats. http://nfllabor.files.wordpress.com/...-2011-2020.pdf Because the release of Hernandez occurs after June 1, the cap hit will be spread over the 2013 and 2014 seasons. Here's the annual breakdown: 2013: If the base salary guarantees in the contract do void, Hernandez will have a $2.632 million cap figure, a cap savings of $1.441 million for the Patriots. If the base salary guarantees — $1.323 million in 2013 and $1.137 million in 2014 — do not void, Hernandez will count $5.092 million against this year's cap, an increase of $1.019 million. 2014: The final three years of signing bonus proration — $7.5 million — are scheduled to accelerate onto the team's 2014 cap. Y! SPORTS But here is the dirty... Had the Patriots not booted him they could have claimed a heck of a lot of money due to section 9 through out the years... Claimed it and not had it count against the Cap... When they booted him they closed the door on that and his bonus was accelerated.. Just like the Denver fiasco with Dumervil. NFL signing bonuses, roster bonuses and option bonuses are subject to forfeiture. And, according to Article 4, Section 9 of the 2011 Collective Bargaining Agreement, a player who is "unavailable to the team due to conduct by him that results in his incarceration" has committed a "forfeitable breach" and may be required to forfeit the signing bonus (or roster bonus, option bonus, reporting bonus) for each year that a breach occurs. If Hernandez is convicted of a crime and serves time, and had the Patriots retained his rights for the duration of his incarceration, the Patriots would have a much clearer path to recoup the $10.05 million in bonus money. |
