That's very true and I didn't mean to say that their gm would be on par with Loomis' ability to manage the salary cap. I was merely implying that the notion of "cap hell" is overused and oftentimes exaggerated i.e. FailClowns' message boards. :-)

If he gets hurt or doesn't perform he could lose a boat load

But there's a big kicker: As much as $12 million can be usurped from the deal if Kaepernick does not play 80 percent of the team's snaps and either reach a Super Bowl or be named first- or second-team All Pro. If he achieves this in the 2014 season, the $12M remains his to keep, but if not he could lose up to $2M per year for as long as he fails to reach those requirements. That's quite an insurance policy there for the 49ers.

All of these idiotic salaries are definitely going to make it look that way. But it's the insanity of each one of these deals that's leading to the next one. As far as I'm concerned all of these QB's are stealing from their teams. It wouldn't be so bad if there were no such thing as the salary cap. But since there is, it's going to get harder and harder for teams to keep their roster's together.

This isn't a bad deal at all imo.
Lots of get outs for the 49ers. If Kapernick doesn't perform he doesn't get the big bucs

I am having a hard time ever remembering a contract this big, that was so heavily loaded with performance perks and incentives. I thought the league (and maybe the NFLPA, the new CBA?) had been sorta trending away from those sort of highly performance-laden deals. I guess not. I would love to see contracts where our wide receiver corps get paid per catch or docked a fine per every drop. Can you imagine how crazy good our young defense would play, if everybody had a payout for getting to the Super Bowl or Pro Bowl, and lost money over the course of their contract, if they didn't get there?
