SANTA CLARA, Calif. (AP) — San Francisco safety Donte Whitner is challenging Drew Brees to come beat the 49ers fair and square — and Whitner hopes that happens in a playoff date in January.

Whitner is still irked that officials called linebacker Ahmad Brooks for a personal foul on Brees late in a 23-20 loss at New Orleans on Nov. 17, and on Wednesday he called for the NFL to take a stand on replay for some illegal hit penalties.

"We look at him as being one of the greats, but come and beat us, come and win a football game, don't take that one," Whitner said Wednesday. "They didn't earn that football game. We felt like we had an opportunity to win it, we felt like we outplayed them and we felt like we should have won. Hopefully, we'll see them again. ... Drew Brees and those guys are over there celebrating. We kind of have a formula against those guys and hopefully we'll see them again in the playoffs."

What would have been a lost fumble instead kept the ball in the Saints' possession, and they soon kicked two late field goals to win the game.

Brooks, who has repeatedly denied any wrongdoing on the play, was fined $15,570 by the league last week and appealed.

Whitner insists Brees "can't take a hit" and that the call cost his team the game.

"I knew it was going to cost us a game at some point. And it's going to cost another team a game when it really matters," Whitner said. "And it might be the playoffs. It could be the Super Bowl. We really need to get something done about that — replay, something — so it doesn't cost us football games. Because we really deserved to win that game."

Brees, whose chin was bloodied when Brooks clobbered him, called it a clothesline tackle. Brees was unavailable to respond to Whitner's remarks Wednesday as the Saints were off.

"We're out there working for nothing. There's no explanation," Whitner said. "There's nobody to actually sit down and tell you what's right and what's wrong. It's like, 'OK, take this fine.' And then you take this fine and that's it. So that's not right because he did everything that he was supposed to do. It's not his fault that Drew Brees is a little guy and can't really take a hit."

Asked to clarify, Whitner said, "I'm not questioning his toughness (but) his stature."

Whitner said he believes he won his appeal of a $21,000 fine for a hit in the end zone on Rams wideout Chris Givens with just less than six minutes remaining in a 35-11 Week 4 win at St. Louis. He would just like to hear a formal answer from the NFL, which has yet to take his money.

"I did everything correct. I actually felt like I put myself in harm's way, turning my neck and not really doing what I'm supposed to do," Whitner said. "The contact could have been a lot worse than it actually was than if I really went at the guy, and I didn't do that. We didn't feel that was fair. I didn't get the money taken and hopefully we'll hear back now."

Secondly, LOL @ the part I left in the quote. They outplayed us? Somebody needs to tell Whitner to look at the stats for that game. We dominated them in all aspects of the game, besides turnovers. And if not for those turnovers, they wouldn't have scored more than 10.

They are nicknamed the "Whiners" for a reason. If they deserved that game they should have been able to score without requiring turnovers to account for all their points. They couldn't produce a single drive of their own. We don't stub our own toes on unforced errors like the Lance Moore punt fumble and 3rd down drops and they aren't even relevant in the game. They earned 3 points on their own. Wow dominating. Go cry somewhere else you little b*%ch.

These niners r clearly mentaly checked out of this world.. I watched that whole game, and its very clear we gave them that game fumbles interception etc and guess what the still only had a 100 something yards on offense,and they could not score enough.. The niners cant seem to just see that they got beat... I'am pulling to play the niners in the playoffs maybe thats smart maybe its not..They xan come back to the dome r we can hop on a plan and fly right to san fran and beat em.. We have beat them there before.. Niners r pathetic...

The San Francisco 49ers' hard-hitting safety withdrew his application to legally change his last name to "Hitner," according to a spokeswoman at the Cuyahoga (Ohio) County Probate Court.

A judge there was supposed to hear the request and make a decision Tuesday. But earlier in the day, the request was withdrawn.

However, Whitner tweeted Tuesday afternoon that he had to withdraw the request because the judge requires him to be present. He said he will do it in the offseason.

I love how no Saints players are responding to this. The 49ers want somebody on the Saints to get offended and respond but we are just relaxing with an extra W in our pocket.

They got the ball back in a tied game with over 2 minutes to go. A field goal or a TD wins it. They went 3-and-out. That's what cost then the game.

And, lol @ the idea that they would have ran the clock out. Almost 4 minutes, time outs, 2 minute warning, terrible average rushing, and they couldn't even pick up a first down when they got the ball back to start a game-winning drive. There's no way they would have ran the clock out.

They need to learn how to play football and get a grip on reality.

If I were Him I would be so embrassed to show my face. With players crying like that u can understand where the fans get all their whineing from. Its just a disgrace. They have probably the dirtiest players in the game on that team (other than Goldson now at Tampa). It is how they are coached. Clearly a penalty by league standards. They were outplayed that's why they lost and I couldn't be more happier than rejoicing in their pain. Its like starting a fight and you get your ass whipped so you look for excuses and something or someone else to lay the blame on. Hope they lose all the rest of their games and miss the playoffs you may have to hire an orchestra to accompany all the crying you will here from them.
