Will Smith's blood alcohol level was severely over the legal limit when the former Saints defensive end was shot and killed in April during a confrontation in the Lower Garden District, two sources with knowledge of the investigation told NOLA.com | The Times-Picayune.

One source said toxicology results, which have yet to be made public, put Smith's blood alcohol content at 0.24 percent, three times Louisiana's legal limit of 0.08 percent. The two sources discussed the report on condition of anonymity because they were not authorized to speak publicly.

It's not like he was on PCP or crack. Yes, he was driving inebriated but that is not a reason for this type of violence.

So. People get drunk all the time. It doesn't always mean they did anything wrong. He was still a relatively young man.

Cardell Hayes' defense team is going to do everything they can to tarnish Will Smith in the press, pre-trial...

Guess they've got to start putting some doubt about Will Smith in the minds of a potential jury pool...

But these are non-disputable facts of the murder/assault...

Hayes ran down and crashed into the back of Will Smith's car after Smith had passed him on Magazine Street...

There's no way in hell you can apply stand your ground as he chased Smith down...

And Hayes not only murdered Smith in cold blood, but shot Smith's wife as well...

How could he also argue she was never a threat?!? These facts, at the very least, lead to Murder II...

Can be used to help the defense show Smith was not able to control himself and was shot in self defense. Will it work....no, not unless the jury is full of liberals wanting to see a murderer walk. To many videos, witnesses and signs pointing to Hayes killing him in cold blood.
