Ochsner: Doctors didn't 'misdiagnose' Saints defensive back Delvin Breaux's injury

Re: Ochsner: Doctors didn't 'misdiagnose' Saints defensive back Delvin Breaux's injury

As discussed earlier in the offseason, Saints must re-evaluate relationship with OHP and put in a better protocol for evaluating contracted players' and free agents' health, availability...

We've discussed this going back to Byrd, then Claiborne, Lewis and then when the Saints signed Fairley who just a few days later was told he couldn't play again because of a heart ailment...

And we're no longer fringe conspiracists when legit local media like Eric Asher began asking his panelists their thoughts on this very issue the past two offseasons...

Now OHP has decided to defend its honor with a shady PR statement...

I would have liked to have been a fly on the wall when the doctor first shared the results of the X-Ray. Did he say it was definitely a contusion? Did he say with the amount of enema present we can't tell for sure, but it may just be a contusion? Did he say it could either just be a contusion or possibly a stress fracture, but with the present edema we cannot tell for sure?

It is possible that in trying to protect their employer's marketing deal with the Saints that they became a bit pliable by the Saints front office. Perhaps telling them what they wanted to hear instead of taking a hard line and telling it like it was. If so, that's more than enough reason for dismissal.

I'm starting to agree with you, JP, that there is something "not right" about the Oschner/Saints partnership. By going to a third party orthopedist there shouldn't be any conflict of interest.

... But they have ruined the careers of many other players with their ineptitude. So, you know, congrats I guess on not misdiagnosing Breaux.

That will never be known. List the players you are referring to. Not saying they shouldn't have been ousted, but I would still like to see that extensive list. I can be convinced.

Like you said, that will never be known. Just conjecture.

Oh, I thought you were talking about known players. Hard to tell. Have we had more players with ended careers than other squads? That would take a hell of a lot of research. Got to bow out of that one. Have a little life left. ;-)

Their lawyers are paid for by my wife's concern. If there was anything "shady" that they knew about ...

That was Chamberlain, right? Chamberlain and Keenan Lewis were the two players that spoke up.

They "misremembered how much verticality his physicality had as they commiserated to misdiagnose while trying to get untracked" So to speak!

Yeah, I think they mean Chamberlain. Claiborne never played for the Saints.

When your talking about professional athletes with multi-million $$$ salaries Ochsner had no choice but to deny, deny, deny that their doctors did anything wrong.

Anything less and Benson would also own a health care system.

Well, somehow Payton got it in his head that Breaux was ready to play but was making himself unavailable. Thus the warning in the press and the trade rumors. Either those doctors gave him that info or they should have corrected him when he first started discussing Breaux's status. Either way, it doesn't look good for them.

Not really. Even if there was a misdiagnoses it is not grounds for any suit. The number one requirement for a malpractice claim to even get off the ground is that whatever occurred caused the patient tangible harm. If there is no harm the claim will be denied immediately with no chance for litigation. Now, if Breaux was told he definitely did not have a fracture and he went out and played on it and it totally gave way and affected his playing career, then he would have grounds. Misdiagnoses and mistakes happen, but the vast majority of the time there is absolutely no grounds for a claim of malpractice and that is the only way to get money. And even in those cases there are legal limits. In this case Oschner has no worries at all since there was no harm.
