Yes ... and No. The Barry Sanders Rules only applies if there is specific language in the contract stating that the player agrees to return (or not collect) any unearned portion of a signing bonus. If the contract does not contain this specific language the entire non-allocated portion of the amortized signing bonus "accelerates" and hits that year's cap in its entirety.

Brees may not have this provision in his contract given his leverage.
