Hayes' defense attorney John Fuller said Sunday that his client's vehicle was rear-ended moments before the fatal encounter, suggesting that collision involved either Smith's SUV or a Chevrolet Impala carrying associates of Smith, and that Hayes was giving pursuit.

Hayes did not enter a plea during an initial court appearance Sunday, and bond was set at $1 million. Prosecutors have 60 days to decide whether to bring the second-degree murder charge against Hayes. Conviction on that charge would bring an automatic life sentence.

Court records show that Hayes will appear before a state judge in Orleans Parish Criminal Court at 3 p.m. CT Monday.

I don't think self defense will hold water. Smith was inside his vehicle when it happened. Even if Hayes went up to Smiths vehicle and Smith flashed a gun. The fact Hayes walked away, got a gun from his vehicle and then came back throws out self defense. That is revenge not self defense. When Hayes went back to his car the immediate threat was over. He could have stayed at his vehicle or fled. Instead he chose to get a gun and go back to engage the threat.
Witnesses have said they heard Hayes remark that he had a gun and then returned to his vehicle.
