Not true. A person can be arrested and booked for suspicion of committing a crime without being charged. There is a period of time in which the prosecutor's office must file a charge or the person must be released. That may vary from jurisdiction to jurisdiction.

A little more detail here ...

Jail records say Cleveland police’s gang investigators arrested Lattimore about 10:30 p.m. Thursday. The records show three other men were arrested by the gang unit at the same time as Lattimore. One was arrested on suspicion of improperly handling a gun in a car and two were arrested on suspicion of having weapons under disability, meaning they illegally possessed a gun with a felony record.

The details of his arrest have not yet been released.

Yeah most states have enhanced penalties for possession of a firearm with affiliation with a gang.

Latt could be in deep ****.

But let's get real here. Rich NFL players, actors and prominent people rarely get what the rest of us get. So I'm sure his fine from the NFL will be worse than anything he gets from the state of Ohio. His attorney will throw something out about how active he is in his community blah blah blah and the court will eat it up.

You have your 72’s but once you are booked the affidavit is submitted for booking. So the judge signs and the da decides whether or not to prosecute. Needless to say he is charged and the judge has signed the affidavit.

You can only be held for 48 hours until formally charged. So we’ll find out something relatively soon.

Hard to believe he would steal something making the kind of money he is, but unfortunately it means he is hanging around with the wrong type of people.

Well, this pretty much guarantees that Winston throws for 4,500 yards and 25 touchdowns this year because they will be giving up 30 points a game on D without Latt and throwing to catch up. Only question is how many Ints. 🙄

This will not end well....given the current environment. Possession of stolen property is bad enough, let alone a firearm. I don't care how Polyanna some believe, this is not good. But it's life, I doubt many, if any one of us in the forum know him personally, so who knows what goes on in someones head.

At a time when he was about to be possibly signing an extension too, wow.

At first when it just said "receiving stolen property", I felt bad for him, and was hoping for the best...maybe he had no idea, etc. But now that it's come out it's a stolen gun, what an idiot. And he's my favourite player on the Saints too, I'm not just hating. Super disappointed in him to read that, you gotta know better there.

Gotta wonder what the fallout from all this is going to be...

So to sum it up... Lattimore was riding around with a couple of guys... all of them had guns. A couple of them were felons and weren’t allowed to have guns. The driver’s gun was out sitting on his lap. Lattimore’s gun was stolen.

In Washington State, possession of a stolen firearm is a Felony....Not like it's someone's bag of marbles....I believe it's a felony in Ohio as well.

What an offseason. Our Hall of Fame QB retires and our best CB is going to be suspended if not going to jail. How quickly things fall apart.

I liked Lattimore a lot, but this will land some jail time unless the DA has a soft spot.

Makes no sense that you have a stolen gun for any reason. If he felt he needed protection just buy your own, or pay for some body guards. Lattimore likely cost himself a 50+mil contract here.

If the DA presses hard, worst case scenario is 5-10 years. Looks like we need a CB in round 1, and hopefully sign Sherman.

I always felt like Lattimore was an elite talent who played at an elite level when he was motivated and felt like it, but not consistently. He would dominate Mike Evans and then get burned by some nobody. He was streaky. He didn't take over games for us in the playoffs. I never liked the idea of having to pay him some record contract. I wish we could have flipped him for draft picks or a more consistent player, but we never had depth at the position to do that due to injuries etc. At least we won't be the ones locking him up long term now. Maybe he gets through the suspension/jail and comes out motivated and we can keep him at a discount for a bit, or maybe he is another teams problem.

Just heard on WWL it might not be as bad as originally expected. He may just have been in the company of felons who had a stolen firearm in the vehicle. The police took them all in and booked them. Police do this fairly regularly so they can get them all in and sort out the details later. If this is case it may not be as bad of a sentence. Either way he’s stupid and will catch a charge of some sort.

Lattimore was still in possession of an illegal firearm. Everyone in the car was carrying and none of them were on the up and up. And what about the company he keeps... Can we trust him?

However this turns out, he is screwed. If he goes to jail, he loses freedom and money. And if he doesn't, he is still going to lose money on his new contract over this.

Precedent states that bonuses paid and expensed in later periods will still count against the cap just as if the player was dropped, traded, retired, or died. See Aaron Hernandez for an example with the Patriots. I read that the basic morality clause in the standard contract is so muddled that it carries little to no weight in this type of potential case.

You can’t consider possession of an object upon multiple people when charges are filled.

The only way he gets out of this is if one of the people he was traveling with claims possession or if the DA goes soft.

What could have occurred, and possibly what they were talking about on the radio is if no one took possession then the driver assumes possession involuntarily. Hopefully that’s the case and one of his “friends” can claim it.

Charges weren't filed yet. He was arrested under suspicion.
