The number one requirement for a malpractice claim to even get off the ground is that whatever occurred caused the patient tangible harm. If there is no harm the claim will be denied immediately with no chance for litigation. Now, if Breaux was told he definitely did not have a fracture and he went out and played on it and it totally gave way and affected his playing career, then he would have grounds. Misdiagnoses and mistakes happen, but the vast majority of the time there is absolutely no grounds for a claim of malpractice and that is the only way to get money.
