The Saints hid nothing from the public that they were obliged to share. They did verify info once Carr went public himself. Besides, the injury that contributed to Carr's decision to retire, according to Carr himself, was not discovered until after he began training for the new season. It was not known until he began throwing well after the end of last season.

But don't let accuracy stand in the way of your hatred of the Saints front office.

If HIPAA applies to teams, explain how teams get fined during the season for not disclosing injuries? Why cant they just claim the player preferred medical privacy? Do league rules supercede federal law? Whenever two coworkers chat about another coworker being out sick is that a federal crime? And how do we even know who leaked abiut Carr’s injury? Maybe it was the Saints.

Have you ever gone to the doctor and signed the form that asks with whom you want information shared? It is a standard waiver. I'm sure every player contract includes similar verbiage allowing limited information being shared with the league. As said, there could be HIPAA considerations depending upon where the information is coming from and whether it is PHI (Personal Health Information). HIPAA applies to healthcare providers (one thing you got right) AND health insurance concerns which includes self-insured health plans. While the team itself isn't subject to HPAA fines, any entity within the team umbrella (like a self-insured plan) that handles said PHI would be subject to those rules and those possible fines.

The NFL is not covered by HIPAA for the injury report because HIPAA covers the Health Insurance (the HI is for insurance), and it is the Team releasing the injury not the Doctor or an insurance company. The NFL is self insured.

It is also in the Ts and Cs of every players contract, they sign it away, just like when I sign away that right to allow my wife access to my medical records.my wife is not bound by HIPAA and can share that information publicly like the NFL does.

Correct! The league is self-insured, as are most teams for added coverage. The league and teams proper are not bound by HIPAA rules, but the internal entities handling the self-insurance are bound by them. The players do sign releases allowing the sharing of certain information under certain circumstances. Teams are required to share injury information to opposing teams during games and between games via the weekly injury reports. Beyond that I believe teams are not required to share any further or detailed information.

The intent is to provide full and complete information on player availability. It is NFL policy that information for dissemination to the public on all injured players be reported in a satisfactory manner by clubs to the league office, the opposing team, local and national media, and broadcast partners each game week of the regular season and postseason (including for the two Super Bowl teams between the Championship Games and Super Bowl).

Any injury information is only required during regular and postseason play. Any off-season sharing could be deemed counterproductive to the team. It is not in any way "need to know" information for fans and/or media.

If it makes some fans butthurt, so be it. I don't want my team sharing any info not specifically required by league rules.
