The NFL is not covered by HIPAA for the injury report because HIPAA covers the Health Insurance (the HI is for insurance), and it is the Team releasing the injury not the Doctor or an insurance company. The NFL is self insured.
It is also in the Ts and Cs of every players contract, they sign it away, just like when I sign away that right to allow my wife access to my medical records.my wife is not bound by HIPAA and can share that information publicly like the NFL does. |

It is NFL policy that information for dissemination to the public on all injured players be reported in a satisfactory manner by clubs to the league office, the opposing team, local and national media, and broadcast partners each game week of the regular season and postseason (including for the two Super Bowl teams between the Championship Games and Super Bowl). Any injury information is only required during regular and postseason play. Any off-season sharing could be deemed counterproductive to the team. It is not in any way "need to know" information for fans and/or media. If it makes some fans butthurt, so be it. I don't want my team sharing any info not specifically required by league rules. |
